Travel Mobile, LLC, the owner and operator of travelmobile.biz together with its subsidiaries and affiliates (collectively, "Travel Mobile") provide you access to this website (the "SITE", or "TRAVELMOBILE.BIZ") subject to the terms and conditions set forth in this legal agreement (the "TERMS"). By accessing, browsing, or using the site, you agree to be bound by the terms and conditions described herein. Travel Mobile reserves the right to change or modify any of the terms and conditions contained in this agreement by updating these terms. Changes and updates are effective upon posting the new terms on the site as revised and your access to and use of the site following the posting of such changes or updates will constitute acceptance of the agreement as revised.

Service

Travel Mobile acts as an intermediary between its customers (users) and mobile operators. By making a purchase from Travel Mobile you agree to adhere to the terms and conditions of the mobile operator providing the mobile phone service you purchased. All policies of the mobile operators that provide mobile phone service are automatically incorporated into these Terms and Conditions of Travel Mobile. If you purchased the service in advance, you will be subject to any changes that the mobile operators may make under the terms of the service between the date you purchased your service and the date of activation of the service.

Illegal Use

It is illegal to use the telephone service for illicit purposes. If the mobile operator determines, in their sole discretion, that you have used the communication service marketed by Travel Mobile for illicit purposes, they reserve the right to terminate your service agreement unilaterally and immediately. If there is evidence that your service has been used unlawfully, the Authorities and the mobile operators may request that Travel Mobile submit or transmit any relevant information, including your identity, to the competent authorities for investigation and prosecution. In addition, Travel Mobile will comply with any subpoenas or judicial or extrajudicial orders, in order to send information, in order to protect its rights and properties.

Improper Conduct

The services commercialized by Travel Mobile may not be used in any way that is abusive, harassing, threatening, libelous, defamatory, fraudulent or invasive for the privacy of third parties, or any other similar behavior. If, in the mobile operator’s sole discretion, it is determined that you have committed any of the aforementioned behaviors, the mobile operator reserves the right to terminate the service immediately and without notice. In this case, the client will still be responsible for all charges, which includes, without limitation, all charges to be billed, plus fees, if applicable. Relevant information, including the identity of the customer, may be presented to the competent authorities for investigation and; or criminal action if the company has reason to believe that the customer has used the service improperly. The customer hereby accepts and agrees to such transmission of information to the authorities. In addition, Travel Mobile will forward information by force of law, subpoenas, court orders, and governmental legal requirements in order to protect your rights and property where any lack of disclosure of vital information that could harm the Company, its customers or others.

Service Activation Date

At the time of purchase the customer must accurately state the date for activation of service to be scheduled. The SIM will be activated the day before the activation date stated on the request. The client acknowledges that the plan will have the validity started from the moment of activation, that is, the day before the scheduled activation date. This is performed to ensure the service is functional as of midnight on the day of activation regardless of the customer’s time zone. This is an exchange in which the customer acknowledges that he will give up 1 day of the validity of his plan for the convenience of having the SIM activated as of midnight on the day of activation. For example, in case the client contracts a 30-day plan, the activation being made 1 day before the arrival date, will cause the plan to extend for 29 calendar days from the activation date requested.

The client can change the activation date at any time up to 48 hours prior to the activation date at no cost. This can be done by accessing the Travel Mobile website and contacting customer service by e-mail or online chat. Travel Mobile is not responsible if the date entered by the customer in the request does not correspond with the exact date the customer arrives at his destination, or if the client does not communicate in time about any change to that date. After the activation is made, the period of the plan begins, and the prepaid credit cannot be reversed or refunded.

Product Delivery

You, the customer, are responsible for informing Travel Mobile of all data necessary to deliver the product at the designated location. It will be up to you to make sure that your name, address and all other data are correct and that they are sufficient for delivery by the post office at the address given. You should also make sure that such deliveries are accepted at the address indicated, since there are some hotels and condominiums that do not receive correspondence of this nature or, or do not do so on weekends, holidays, or that may take a few days to deliver to the recipient, which would detract from the receipt by you within the desired time frame. It is up to you to make these checks and inform Travel Mobile of the need to ship the product in advance, if applicable.

All these checks must be done by you before the order is completed, thus ensuring that there will be no problems for delivery of the product by the post office. Since it is your responsibility to correctly inform your data and the delivery address of the product, as well as verify the local rules regarding the receipt of this type of correspondence, it is hereby agreed that Travel Mobile will not be liable and will not refund amounts paid by you by the product or in relation to postage costs when the product cannot be delivered to the address indicated by mistake in the data provided that have made delivery impossible, or if it is impossible to make the delivery or delay due to rules relating to the receipt of correspondence at the delivery address indicated.

Travel Mobile is not responsible and will not refund the purchase cost if there is a delay in delivery of the product due to:

  • Change in the arrival date of the customer without notice of at least 48 hours to Travel Mobile
  • Change in the date of arrival in less than the transit deadline for delivery on the date defined in the request
  • Change of place of delivery without prior notice to Travel Mobile
  • Alteration of the place of delivery of the product in a term shorter than the period of transit for delivery on the date defined in the request
  • In special circumstances such as storms, snowstorms, wildfires, natural disasters and other adverse climatic conditions, as well as in case of strike of the post office, war or insurrection

Any change in the data provided when contracting the services / products, mainly date and place of delivery should be communicated to Travel Mobile through its contact channels disclosed on the website, in order for the customer service team to take the appropriate measures necessary to guarantee delivery and activation of the service on the requested date.
